کاربست حقوق بین‌الملل به عنوان قدرت مولد در سیاست خارجی ایالات متحده آمریکا پس از یازده سپتامبر

چکیده
ایالات‌متحده آمریکا در راستای بازیابی شأن و منزلت بین‌المللی خود پس از یازده سپتامبر 2001، به طرح ریزی و اجرای راهبردهایی در راستای بازتولید قدرت خود اقدام کرد و در این مسیر تلاش بسیار نمود تا هم منابع تولید قدرت خود را کارآمدتر نماید و هم منابع جدید قدرت را پی‌ریزی کند. بنابراین ایالات‌متحده در کنار قدرت اجباری، قدرت ساختاری و نهادی سعی در فعال سازی بعد جدیدی از قدرت به عنوان قدرت مولد ساخت. اما سوالی که پیش می آید آن است منبع تولید قدرت مولد ایالات‌متحده در عرصه بین‌المللی چیست؟ درراستای پاسخ به این سوال، فرضیه مقاله آن است که حقوق بین‌الملل مهمترین منبع تولید قدرت مولد ایالات‌متحده آمریکا پس از یازده سپتامبر است. در راستای فهم هرچه بیشتر این فرضیه نیز تحول مفهوم حقوق بین‌الملل توسل به زور در قالب تحول اصل دفاع مشروع، مداخله بشردوستانه و مسئولیت بین‌المللی حمایت پس ازیازده سپتامبر به عنوان مطالعه موردی در این مقاله مورد واکاوی قرار میگیرد. این مقاله با روش توصیفی-تحلیلی و با استفاده از منابع کتابخانه‌ای در راستای اثبات این فرضیه گام برمی‌دارد.

چکیده English

The United States of America to restore its international dignity since September 11, 2001, it has devised and implemented strategies to reproduce its power, and has made great efforts to improve both its power generation resources and to deploy new sources of power. So the United States, along with compulsory, structural and institutional power, is trying to activate a new dimension of power as productive power. The question that arises is what is the source of the United States' international production of productive power? To answer this question, the paper assumes that international law is the most important source of US productive power after 9/11. To further understand this hypothesis, the evolution of the concept of international law by force in the context of the evolution of the principle of legitimate defense, humanitarian intervention, and international responsibility for protection after September 11 is examined as a case study in this article. This paper takes a descriptive-analytical approach and uses library resources to prove this hypothesis.
