Judicial and legal rules such as rules of "Use your own property in such a manner as not to injure to another", "to be the cause or occasion of ", the regulations inserted in the international documents such as Article 8 of The Universal Declaration of Human Rights, Article 21 of Rio Declaration and Clause 3 of Article 2 of the International Covenant on Civil and Political Rights confirm that people suffered from environmental pollution must be compensated. </span> <br /><span style="font-family: Times New Roman;">One of the effective solutions for compensation is, resorting victims to their respective state courts and filing legal claims against the responsible government. Typically, the defendant governments cite the principle of judicial immunity to get rid of compensation. To withdraw the immunity, the courts must refer to international rules, especially, Article 12 of Convention on Jurisdictional Immunity and their Property, and render judgment in favor of those affected.</span> دولت به لحاظ فعل یا ترک فعل خود در زمینه آلودگی زیست محیطی مسئولیت دارد. قواعد فقهی و حقوقی از قبیل لاضرر، تسبیب، مقررات مندرج در اسناد بین‌المللی از جمله ماده 8 اعلامیه جهانی حقوق بشر، ماده 21 اعلامیه ریو، بند 3 ماده 2 میثاق بین‌المللی حقوق مدنی و سیاسی مؤید این موضوع هستند که می‌بایست به افراد زیان دیده از آلودگی زیست محیطی غرامت پرداخت شود. یکی از راهکارهای مؤثر برای جبران خسارت، توسل زیان‌دیدگان به دادگاه‌های دولت متبوع خود و طرح دعاوی حقوقی علیه دولت مسئول است. به‌طور معمول دولت خوانده برای رهایی از پرداخت خسارت به قاعده مصونیت قضایی استناد می‌کنند. در راستای سلب مصونیت دادگاه‌ها باید ضمن استناد به مقررات بین المللی، بالأخص ماده 12 کنوانسیون مصونیت قضایی دولت و اموال آنان مبادرت به صدور رأی به نفع افراد زیان‌دیده نمایند https://www.spba.ir/article_45008_b816130e1431fcf42ec895b272d975bd.pdf
